BDKV publishes guidance on direct licensing

The new BDKV guidelines provide guidance on direct licensing and help event organisers make legally sound decisions.

At the end of May, the Federal Association of the Concert and Events Industry (BDKV) published new information material on the subject of direct licensing. The background to this is that rights holders are increasingly granting their usage rights directly to event organisers, thereby bypassing GEMA. The new guide is intended to provide information on the legal framework and offer guidance on implementation.

As direct licensing can take place in parallel with existing rights management systems, there is a risk of double payments and ambiguities regarding the assignment of rights, amongst other things. Contracts and invoices therefore require particularly careful scrutiny.

This is particularly relevant for booking agencies, concert promoters and event planners. The guide is intended to help reduce legal risks and provide greater certainty when drafting contracts and licensing agreements.
